These Terms of Service ("Terms") govern your access to and use of the DMALL OAuth2 application (the "OAuth2 App") and the DMALL service at dmall.tech (together, the "Service"). The Service is operated by Billo Chhetri ("DMALL", "we", "us", or "our").
By signing in, authorizing the OAuth2 App, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The OAuth2 App is used only for Discord sign-in and server-access verification. It is separate from the DMALL sender bots that deliver broadcasts. The OAuth2 App does not join servers, send messages, or read message content.
1. Eligibility
You must be at least 13 years old, or the minimum age required to use Discord or consent to online services in your country, whichever is higher. If you are below the age of majority where you live, you may use the Service only with the involvement of a parent or guardian. By using the Service, you represent that you can form a binding contract with us and that you have the authority to act on behalf of any organization or server you represent.
2. The OAuth2 App
When you authorize the OAuth2 App, Discord asks you to approve the identify and guilds scopes. We use this access to identify your Discord account, load the servers you belong to, and determine which servers you own or can manage. We do not request access to your email, connections, direct messages, or message content.
You can revoke the OAuth2 App at any time in Discord under User Settings → Authorized Apps. Revocation stops future OAuth access, but it does not automatically delete data already stored by DMALL.
3. The DMALL service
DMALL helps server owners and managers prepare and deliver broadcasts to members of Discord servers they own or manage, using official Discord bot applications. You are responsible for the messages you create, the servers you select, the recipients you target, and the sender bots you add.
You must have the necessary authority over any server you connect or send to. You must comply with Discord's Terms of Service, Community Guidelines, Developer Terms, Developer Policy, and any other applicable Discord rules. DMALL is not affiliated with, endorsed by, or sponsored by Discord.
Delivery is not guaranteed. Discord may impose rate limits, restrict bot accounts, block messages, or change its API at any time. A recipient's global DMALL block is honored before delivery, and some recipients may have DMs disabled or may otherwise be unreachable.
4. Acceptable use
You must not use the Service to:
- Violate any law or Discord rule, or infringe the rights of another person.
- Send spam, unsolicited bulk messages, or messages to people who have asked you not to contact them.
- Harass, threaten, defame, or discriminate against anyone, or send hateful, violent, sexually exploitative, or otherwise unlawful content.
- Distribute malware, phishing links, fraud, scams, or deceptive or impersonating messages.
- Scrape, harvest, or compile recipient data for unrelated purposes.
- Access the Service by automated means that bypass rate limits, security controls, or access restrictions, or interfere with its operation.
- Reverse engineer, decompile, or attempt to extract source code except where the law permits it.
- Resell, rent, sublicense, or provide access to the Service without our written permission.
- Circumvent a recipient's global block or any other safety control.
We may investigate suspected violations and may suspend or terminate access, remove content, or report conduct to Discord or law enforcement where appropriate.
5. Your content and responsibilities
You retain ownership of the messages, templates, and other content you create. You grant us a limited license to host, process, transmit, and display that content as needed to provide the Service, including delivering it through sender bots. You represent that you have all rights and permissions needed to use and send that content.
You are responsible for obtaining any notices, permissions, or consents required by law or Discord rules before contacting recipients. You must not use the Service to send confidential information that you are not authorized to disclose.
6. Accounts and security
You sign in through Discord. We do not store your Discord password. You are responsible for keeping your Discord account and devices secure, and for all activity that occurs through your authorized session. Tell us promptly if you believe your account or a sender bot has been compromised.
7. Third-party services
The Service depends on Discord and on infrastructure providers. Those services have their own terms and privacy policies, and we are not responsible for their acts, omissions, availability, or changes. Discord may suspend or restrict your account or bots independently of DMALL.
8. Availability and changes
We provide the Service on an as-available basis. We may modify, suspend, or discontinue features, impose limits, or perform maintenance at any time. We do not guarantee uptime, delivery, delivery speed, or that a broadcast will reach any particular recipient. We may change these Terms as described below.
9. Fees
The OAuth2 App is provided without a separate fee. Some DMALL features may be paid or require wallet credit. Any applicable price, charge, refund rule, or minimum will be shown before you confirm a purchase. You are responsible for taxes associated with your use of the Service.
10. Suspension and termination
You may stop using the Service at any time and revoke the OAuth2 App in Discord. We may suspend or terminate your access if you violate these Terms, create a security or abuse risk, fail to pay applicable charges, or if required by law. On termination, your right to use the Service ends. Sections that by their nature should survive, including ownership, disclaimers, limitation of liability, and indemnity, will survive.
11. Intellectual property
The Service, including its software, design, text, graphics, and the DMALL name and logo, is owned by us or our licensors and is protected by intellectual-property laws. These Terms do not grant you any ownership or license except the limited right to use the Service in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.
If you provide feedback or suggestions, you grant us a perpetual, royalty-free license to use them without restriction or compensation.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation. We do not warrant that messages will be delivered, that recipients will receive them, that bots will remain available, or that data will never be lost.
13. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising out of or relating to the Service, even if we were advised of the possibility. Our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 100. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or intentional misconduct.
14. Indemnity
You agree to indemnify and hold harmless DMALL and its officers, directors, employees, and contractors from claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your messages, your violation of these Terms, or your violation of another person's rights or applicable law.
15. Governing law and disputes
These Terms are governed by the laws of Nepal, without regard to conflict-of-law rules. The courts located in Birtamod, Jhapa, Nepal will have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court. If you are a consumer, you may also have rights under the mandatory laws of your country of residence.
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on this page and change the effective date. If a change is material, we will provide reasonable notice where required by law. Continued use of the Service after the effective date means you accept the updated Terms.
17. General
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to us must be sent to the contact below.
